"Contributions to an employees' trust made by an employer during a taxable year of the employer which ends with or within a taxable year of the trust for which the trust is not exempt from tax under section 501(a) shall be included in the gross income of the employee in accordance with section 83 (relating to property transferred in connection with performance of services), except that the value of the employee's interest in the trust shall be substituted for fair market value of the property for purposes of applying such section."

Yeah. And this is the reading for the first day of this class. What have I gotten myself into? I don't even know what section 501 or section 83 are, and they weren't assigned, and we don't talk about them the first day. This should be an interesting semester.

I got called on the first day in my Tort class, and it was nightmarish. Just ask Steven - he can attest. It's like my voice stopped working, and I stopped talking before it sounded like I ought to. Oh well. Not sure what to do about that. Just try to act inconspicuous, I guess.

I think this moot court thing is going to help my public speaking abilities. Either that, or it'll kill me. I'm not sure which yet.

Here's wishing a great day to all!

Saturday, December 03, 2005

1. I love to scrapbook, but the only enjoyment I gain from my scrapbooks is when other people look through them.

2. I am filled with a ridulous amount of joy when I peer into the cage of the cutest little rat faced creature I've ever seen and I do this on average 50 times per day.

3. I love home-cooked meals but hate to cook.

4. I visit Westlake Hardware Store for one purpose - to stock up on their red vine licorice - I swear it's the best I've ever tasted. I have five bags of it right now.

5. I go to the movies - first, for the nachoes, second, for the movie (third as a reason to eat the red vine licorice from Westlake I snuck in to the theater).

Unfortunately, I only know two people techology savvy enough to know what a xanga or web blog is, and they've both already made their lists. I do love playing tag, though - I haven't played it in years.

Sorry Steven - I've no one to tag. But thanks for tagging me! It was fun.

Thursday, November 17, 2005

Ah, the question of the day, once again from Civil Procedure:

" Is the outlawry, according to State law, of a claim created by the States a matter of "substantive rights" to be respected by a federal court when that court's jurisdiction is dependent on the fact that there is a State-created right, or is such statute of "a mere remedial character," which a federal court may disregard?"

Care of Mr. Justice Frankfurter of the Supreme Court in 1945.

And the answer is.... who the *^%$@ knows? And - is outlawry really a word?

Ah, the joys of Civ Pro II. I might throw a party once that final is over.

Wednesday, November 09, 2005

Crim Pro Excerpt:

"There is no doubt about the answer that proponents of question-first give to this question about the effectiveness of warnings given only after successful interrogation, and we think their answer is correct."

What answer? Huh?

Anyway. I hope that paragraph is not indicative of the direction my day is headed. At least I didn't cause myself to look like a battered wife today (yesterday I smacked my cheek/eye into a drawer just before leaving home at 6:15 AM).

FYI - I'll be out of town starting Thursday night, and I'll arrive back home on Tuesday. Pam - dinner's Tuesday instead of Wednesday next week. But I'll hopefully see you tonight for dinner this week.

Have a great day, all.

Steph

Thursday, October 27, 2005

Civ Pro II:

"The specific purpose of the complete diversity rule explains both why we have not adopted Gibbs' expansive interpretive approach to this aspect of the jurisdictional statute and why Gibbs does not undermine the complete diversity rule. In order for a federal court to invoke supplemental jurisdiction under Gibbs, it must first have original jurisdiction over at least one claim in the action. Incomplete diversity destroys original jurisdiction with respect to all claims, so there is nothing to which supplemental jurisdiction can adhere."

Ugh.

How about: "Rejecting that argument, the Court held, 'on the question of removal, we have not to consider more than whether there was a real intention to get a joint judgment, and whether there was a colorable ground for it...as the record stood when the removal was denied. If there is a joint liability, he has an absolute right to enforce it, whatever the reason that makes him with to assert the right. Hence, the fact that the company is rich and Barrett is poor does not affect the case.'"

Uh, yeah, I see how they got to that...Not.

Crappy crappy day. I can't wait till 3:30.

Thursday, September 29, 2005

Oh, and Steven -

You do have a squeegie way of killing bees... and wasps... in the shower - is this ringing a bell?

On the other hand, I am now currently working for a firm in Crown Center. I started Wednesday, so to answer your question, Steven, that's why I was "all gussied up." I interviewed for the job on Monday and they offered it to me in the interview. Yesterday, my first day, was supposed to be training, but my boss decided to forego that, and I was just thrown right into the legal work. All I can say is - thank goodness for Intro to Law! I immediately began researching for a case they're working on, and was asked to write a statement of facts for a motion. I also had to look up relevant statutory law and match state law with a model code. It was pretty intense and exciting. I think I'm going to love being a lawyer.

That's all my news for now.

Thursday, September 22, 2005

Hey all, wish me luck in my Air Force Jag Corp interview this morning. I hope it goes better than my last interview. Maybe they'll actually ask me some questions this time instead of expecting me to direct the interview. I am glad it's only a twenty minute interveiw, though. I'm pretty excited that I got the interview - I'd love to intern for them this summer. Jag Rocks!

In other news, my bronchitis is still prevailing over my state of mind and making me foggy in class. Hence the incident in Family Law where I had difficulty locating the case in the textbook. I didn't feel too badly, though, because I noticed that no one else could find it either, because she had skipped back a chapter on us.

Ballet class if fun, but killer. We have to do these stupid turns that make me dizzy as hell. I'm going to have to practice those at home because I don't want to look like a fool in class again. I did notice that the guy next to me was having the same difficulty, though. We found it quite humorous, but I'm not sure our teacher did. (Can I really find it within myself to call a girl 10 years younger than me "Miss Jessica"? Hmm..)

I think Mia has left town for the winter - I'm so sad to see her go, but at least now I can take down the feeders and stop attracting bees so close to the house - they keep coming inside! I currently have one trapped in the hall bathroom. Ack. How do you kill a bee without getting stung? Steven - maybe I'll have to use your method - the squeegie thing. Who knows. Maybe I'll just keep it trapped in there until it dies or disappears.

        Have a great day, all!

Steph

Friday, August 19, 2005

I AM VICTORIOUS!!!

I'm so excited. I just went to let Daisy out, and as I was opening the door, I happened to look up at my hummingbird feeder and noticed --- I HAVE A HUMMINGBIRD!! YAY! If you were wondering - I've been trying to attract a hummingbird for over two years, with no luck. Finally - a reason to keep changing the nectar!

In other news - I have started a job editing depositions for a court reporting company. I'm also very excited about that. I've also applied for another school year job as a legal intern - we'll have to wait and see where that goes. I really hope to get the job. Not to mention that school starts up on Monday.

I had a super time hanging out with Steven on Wednesday. He introduced me to a new TV show that I'm very intrigued by - it's called Boston Legal. It stars James Spader, Monica Potter, Candice Bergen, and William Shatner, and it's quite good. I fear it will take up an hour of my time each week now that I'm hooked. I can't stop thinking about that show! We also had an Arrested Development marathon which was great fun, as usual. He's so sweet to record those shows for me and then watch them a second time with me. Steven also introduced me to a game called Wario Wares - I was terrible at it, but it is a blast to play. (I don't know that he had a blast, as I kept messing up and he kept having to tell me how to play.)

Well, off to read more. I still have four out of five assignments to finish reading. Ack. Plus my first deposition to proofread and the English Guide for Court Reporters to peruse to figure out exactly what they want me to correct beyond the obvious.

Have a great day all!
