THE CHOICE IS YOURS "CONNING & CHEATING YOURSELF" WRITTEN BY: JOSEPH P. PAYNE SR.
From this prison cell, I've spent many hours of the last 23 years thinking about my past and the "stupid- mistakes I've made which have led me to prison and, to being sentenced to death. Believe me when I tell you that I've made plenty of mistakes and stupid decisions without thinking or caring how these mistakes or stupid choices would eventually affect my life and the lives of others. Believe me when I tell you that when you end up in prison or on death row, you will have nothing but time to think about how you allowed yourself to con and cheat yourself out of life and good times. You will have nothing but time to remember how you could have avoided spending most or all of your remaining life in a prison cell, or waiting to be executed, if you would have thought seriously about what you were doing before you acted and ended up in prison or on death row. It is my hope that you won't end up like me, thinking about how stupidity hurt you from a prison cell, and that is why I'd like to share one of the biggest mistakes I've ever made with you. The choice was mine but I didn't think about the affect that my choice might have on me or other people.
Growing up in my teen years I was in trouble with the law and courts several times. Running away, shoplifting, car theft, breaking and entering, driving without a license, driving while intoxicated, and possession of and distribution of drugs are some of the things I was into. I ended up getting arrested, locked in jail, put into reform school, and spent time grounded or restricted by parents.
Each time I would end up in trouble with the law, courts or adults I'd tell them and myself I wasn't going to do whatever I was in trouble for again. While I was in trouble and suffering the consequences I'd keep my act together and would stay out of trouble, swearing I had learned my lesson. But, not long after my punishment and the trouble was behind me it wouldn't be long before I was back into getting high or drunk, or getting , mixed up with people who were into steeling or breaking the law in some way. Skipping school, shoplifting, running away, and doing other things that "I knew" could get me into trouble and locked up again. When I would go back to a lifestyle which I knew could get me into trouble or jail I had plenty of excuses to justify my actions to myself.
Realistically I was just conning myself with excuses like the following:
1. My friends are doing it and I don't want to be thought of as a wimp or uncool. 2. I'm not going to hurt anyone, I'm just having some harmless fun.
3. So what if I'm getting drunk or high? I'm not hurting anyone and I can handle It. 4. I need to get high and wasted to feel better.
5. I know what I'm doing, I won't get busted, addicted, or overdose.
6. I'm not addicted to drugs or alcohol, I just like the high, I can quit anytime I want, I just don't want to.
7. There is no harm in selling drugs or stolen goods so I can make some money that I need. Besides, I know what I'm doing, I won't get caught.
8. I'm tired of being without, and these people are rich or have insurance so stealing from them or robbing them won't hurt them. 9. I'm not going to school because it's a drag and I know that stuff they are teaching. I'll never need to know the stuff they are trying to teach me. I'm smart enough without the hassle of school.
10. Maybe if I do this someone will pay attention to me and take me seriously.
11. I'm not going to do this (whatever it is) all the time I just want to experiment and see what it's like. A lot of people make a lot of different excuses to justify the fact that they are doing something wrong. Sometimes people just do something wrong to see what it's like, and they say well just this one time won't hurt anything or anyone. This is a lie! If it can get you into trouble or cause you to depend on it (like drugs & alcohol), the truth is that it can get you locked up, and there is always a high possibility that something could happen that you don't expect, that could cause yourself or someone else to be seriously hurt. Although I "didn't think about it" I knew then, and now, those excuses were stupid lies that I was telling myself or being told by someone else. I lied to Judges, police, probation officers, teachers, principles, reform school counselors and parents. Yea, I thought I was one slick and cool operator as I conned them all. But what I didn't realize then, but, now know after spending the last 23 years in this prison cell, is that the person I was really conning and cheating the most was myself. I believed my stupid excuses and I went on doing what" I knew" could get me into serious trouble and ended up cheating myself out of so much life. I cheated myself instead of doing the right thing or finding a good way to deal with a problem that would benefit me instead of hurt myself. All the years I spent in boys homes, trade school, and jail I cheated myself out of the opportunity to be free and doing the other things that other kids were doing and enjoying. By skipping and dropping out of school in the 8th:, grade, I cheated myself out of an education that I needed in order to get a good job and have a successful career. I didn't think about the future when I quit school, but when I tried to get a job I found out that getting a job required that I know math and many other subjects taught in school that I had not learned. By not thinking of my future and employment I had conned and cheated myself out of having a good job or a successful career.
Then there was the experimenting and use of drugs and drinking beer, wine, and whiskey. I had plenty of excuses why I needed or wanted them, and after telling myself these lies I began to believe them. I swore I knew my limit, how to control myself and the drug when high, and that I'd never be addicted. Again, I was only conning and cheating myself and I never stopped to really think about it. I stayed high so much that when I did think about it I was high and didn't really think about it seriously. I ended up becoming addicted to drugs and alcohol and had many occasions when I could not recall what I had been doing while high. A large portion of the money I made by employment was spent on supporting my habit. I refused to pay attention to the forgetfulness, the blackouts, the way I would become mean at times, or the sickness of not having drugs or alcohol that I would go through. I also refused to recognize that the reason I jumped from job to job was because of my addiction. There were many signs but I conned and cheated myself with all of my stupid excuses.
Finally a day came when my mind and body was totally burnt out but, when I awoke I started my day with my usual routine. A couple bong hits, a couple shots of whiskey, or beer, and 2 hits of speed. I went out partying with someone and many hours of partying with whiskey and PCP, myself and this other person somehow ended up robbing a store. When we left the store clerk was dead. I came somewhat to my senses in jail but not knowing what I was there for or anything about the crime we had committed, but, that didn't stop the judge from giving me a life sentence plus one year in prison. I could have received the death penalty.
Another way you Cheat yourself when you keep going back to the same lifestyle that you know is against the law is, before you realize it you've been in trouble more times than you can count and you now have a reputation of the type of person likely to steal, rob, use or sell dope, or whatever you've been continuously doing. When you get this type of criminal reputation you make it easy for someone to accuse you, and if you can't prove that you really didn't do it you may not be believed or trusted. This could very well lead to you're being jailed based on the fact and "circumstantial evidence" that you are a likely suspect because you've done it so many other times. This type of reputation can and will prevent you from getting jobs or certain type of social memberships. These things may not seem so important now when you are between the ages of 10 and 18 years old, but they should because everything you do today can and usually does affect you tomorrow.
I have learned the hard way going through these things I've spoken of, and have met many people in prison who have also made the same stupid mistakes. Particularly the mistake of waiting to late in life to think about the trouble these mistakes can cause them. Most of us in prison have spent most of our life conning and cheating ourselves and, causing ourselves hassles that were really unnecessary. Well, "I'm thinking about it now!" I've been thinking about it from behind bars for the last 10 years. Each day I miss the legal things I enjoy doing while remembering how many chances I had to get my act together. But, I was a fool! Will you also be a fool?
THE CHOICE IS YOURS! What are you going to do? will you continue to con and cheat yourself until you end up like me, sitting in prison year after year, not knowing if you'll ever see the outside world again or die behind these prison walls? Do you think you are too slick, cool, or such a player that you won't end up in prison wishing you would have given what you were doing more thought? If you do, it's your choice but, be forewarned that these prison walls are full of people who also thought the same thing. Prisons and death rows and even mental institutions are full of people who kept conning and cheating themselves the same way.
I can only tell you what I know from experiencing and seeing it happen the hard way, the rest is up to you. It is your life and your future. THE CHOICE IS YOURS! Are you going to be spending your future free and happily, or will you be spending it in a prison cell wishing you would have thought things out more maturely and gotten your act together? Knowing how much I regret and have suffered .as each year I sat behind bars getting older and missing so many good things as these prison walls sucked the life out of me, I hope you won't be one of the people I see come here or to any other prison. Please take advantage of the fact that you can know what the real deal is without experiencing it the hard way. If you ever want someone to rap to to help you decide whether you'll be making a serious mistake by doing something, I'd be glad to rap with you. I don't know it all but I do know that "nothing" is worth the life you'll have if you come to prison, and I know it can be avoided simply by thinking before you act. Many times you are glad to do a friend a favor, well, do yourself the favor of thinking seriously about where you are going in life and about what kind of life you're living now. Be smart by not letting others convince you of getting into things you know are wrong or harmful to you or others. If they were really your friend they wouldn't be trying to lead you into something that can hurt you or screw up your life. If you can be smart enough to do yourself this favor now, I know you'll be glad you did later in life. The best of luck to you!

| Rehabilitation?
Are prisons supposed to warehouses of society’s rejects or are they supposed to rehabilitate criminals so that they may become productive members of society?
It seems to me that they are warehouses. If the prisoners were dogs or cats the American Society for the Prevention of Cruelty to Animals would be pitching a fit. In many cases they are treated worse than you hear about the racing dogs, circus animals and rodeo animals.
What surprises me is that some prisoners do come out better people than they were when they went in. The reason is that while they were there they realized their mistakes and came to the conclusion that they did not want to come back. Their outlook on life changed and in spite of the conditions they realized that it is their fault that they were there.
Another thing that surprises me is how many innocent people are in prison. Some of them work to prove their innocence and spend their time on their cases when they are allowed to. It surprised me that many of them after years of false imprisonment are good people and they have not been destroyed by the system that put them there.
What doesn’t surprise me is that many of the innocent prisoners are turned into a menace to society and come out of prison to become criminals and/or substance abusers.
Prisons can take a good man and turn him bad or a bad man and turn him into a worse man.
Yes some prisons have rehabilitation programs including drug programs, education programs, vocational training programs, work release programs and other methods of rehabilitation.
They also have drugs that are smuggled in by visitors and guards. They have cruel guards who keep the prisoners down, beat them, set them up for cases against them, look the other way when they are attacked by other prisoners and have other ways to physically and mentally abuse them. The infirmaries have doctors who can not work anywhere else (Many who are not even licensed.) because they are incompetent, nurses who ignore their needs and guards who abuse them. In some cases the prisoners who work there are the only ones who care and are the only ones who are competent.
Prison is a big business and those who run the system want the repeat offenders to come back. They have a vested interest in not turning out rehabilitated prisoners. Many guards, wardens and other prison staff members make money off the system.
Many people say that prison is for punishment. Conditions for the convicts are supposed to be harsh. They get what they deserve. Make life miserable for them. What they do not realize is that most of the prisoners will return to society.
It seems to me that we would save money and lives if the prisons rehabilitated the prisoners and treated them humanely. Give them training for jobs and educate them. Give them treatment for mental illnesses. Give them quality medical care. Give them drug abuse and anger management programs.
We have to realize that the loss of freedom and control of your daily life is the punishment portion of being a prisoner. The prison authorities can stop the drugs from coming into the prisons. They can hire people who care.
Then we have the parole system. I have met parole officers who care. They work with the men and women that they have control over. Then you have the ones that do not care and harass instead of help. We also have the problem of too many cases for the parole officers. They do not have the time to do the job that needs to be done.
The object of parole is not only to violate the parolee when he makes a mistake but it is also to help the parolee blend back into society. It is supposed to help the parolee stay out of prison not to put him back in.
One thing we have to realize is that people change. The person you send to prison is not the same person that gets out. Who that person is when he or she gets out is dependent on the treatment they receive in prison.

| The Good Old Boy Network
I hope a lot of people read this and get mad enough to react and do something about it. There is a danger to me because there are people in jail for pissing off the good old boys.
On television you see the good old boys in shows like “In the Hear of the Night” and other shows that take place in the small towns of the south. It is not only there but it is all over the country and no doubt all over the world.
You have heard of dream weavers. The good old boys weave nightmares. There are many people in prison, many of them on death row. There are also innocent people who have been executed because of the good old boy network.
The death penalty is big business and prisons are big business. The call of the good old boys is, “Get that SOB even if he is innocent.” Instead of solving the crime they dispose of it by convicting a person whether they did it or not.
There is a murder case that the prosecutors want out of the way. If it is high profile it is a stepping stone to bigger and better things for everyone involved. The cops will frame a person because they feel that the case will help them go up in the department, for money, just to get the crime into the solved file or because they do not like the guy. The prosecutors will work with the cops and the coroners may also be in on it. They may use evidence that has been planted, rigged or non existent. They will use only parts of a coroners’ report that will help convict and ignore the evidence that shows the person is innocent. They will use witness’s who are known liars. They will even use the guilty person’s testimony to convict the innocent person.
Why won’t the judge do something about it? Three reasons, because they are incompetent, because they were financially rewarded or because they are one of the good old boys.
Why don’t the defense lawyers do something, because of the above reasons, because they are drunk or because they are asleep?
Many innocent people will plead confess and plead guilty because they feel that if they do not they will get more time in prison. Being innocent is not a reason to fight a losing battle.
The defendants in these cases are poor and can not afford a lawyer so they have to use the public defender who works, in most cases, indirectly for the prosecutor not the defendant. If they are really bad at what they do they rewarded with more cases and since they are not good enough to get paying clients they depend on the prosecutors and/or the judges for their income.
If you are rich or middle income you probably do not know or care about the good old boy network. It does not effect you until someone in your family is killed because the wrong man went to prison for a murder committed by your family members killer. Even then you may never know.
If you are poor you may know about it. If you are not white you may know about it. If you are black and poor the odds are that you not only know about it but you know someone who has been railroaded or you may have been railroaded by the good old boys.
I am willing to bet that at least 10% of the people in prison and on death row are innocent victims of the good old boys. Using that I would also bet that over 10% of those executed were probably innocent.
But then you say, “If there is evidence that there was a miscarriage of justice in a case can’t it be corrected.” The answer is not very often.
Virginia for example has a law that if you do not appeal a case within 21 days of sentencing with evidence known at that time you are out of luck.
The system makes it very difficult if you are wrongfully convicted to get a chance to prove your innocence. Even if they witnesses admit that they lied, the victim admits that they were wrong or another person confesses and the evidence backs up the confession the odds are against the case being overturned. Why? The good old boys network protects their own.
Those of you who do not believe me go to the internet search engine and look up innocent prisoners and you will find that there are many more than you imagine.
One is too many.
All I ask is that innocent people are not railroaded and those that do serve at least the time they served and if the innocent person was executed they serve life without parole because my friends they murdered that person who was wrongfully executed.

| The Castle of Hope for Lost Souls Our project and goals
I am Lee, the chairman of the board. I am a reformed drunk. My life has been good and bad over the years but as I look back even the worst has some good in it. If it were not for the bad I would not be who I am today. If you take a look at The Injustice System, the castle of hope and the crazy old white man from the hood you will find out who, what and why I am.
Carmen is my heart. She is a recovering addict. Together we will help many of the lost souls find themselves as we did. Carmen’s story follows.
The Internet:
The Internet portion of our project is already in operation the links are on our home page. The Injustice System site is always changing. I was going to put the last change date on but I change it almost every day so it would be meaningless.
Support Groups:
Eventually we want support groups for: drug addicts, alcoholics, ex-cons, young people in trouble, abused persons, the homeless, the mentally ill, other lost souls, friends, families and other loved ones. These groups will not be lead by psychiatrists, psychologists or social workers but we will try to have volunteers in those professions to be available if needed. These groups will be made up of those who the groups are helping.
Religion:
These groups will be non-denominational. Our main concern is the individual. The individuals must first find themselves and respect themselves before they can recover. We will be in contact with ministers of different faiths whether Christian, Moslem, Jewish, Hindu, Buddhists and others.
I am also planning a church like service for all. This would be non-denominational and instead of a cross on the altar there would be a wheel with the symbols for the various beliefs on the end of the spokes. This way all would have an equal place. We would have a library of reading material and the holy books of those religions.
The “services” would be for all and would talk about love of yourself and others. It would be about a way of life instead of religion however as I said above there would be contacts with ministers of the different faiths and they would be able to speak also. We would have guest speakers from all faiths.
Jobs:
We would also help people from the groups find work.
Shelter:
We would help find shelter for those who need it and homes for the homeless.
Prisons:
Our prison systems are an embarrassment to the country. If you look at the Injustice System site you will see the treatment these people get. You have anything from medical neglect to murder committed by inmates with the guards watching or by the guards themselves.
There is a case where the prison officials the said that the prisoner died of a heart attack. When the family finally got the body they found that he had a broken back, legs, arms and ribs.
Many prisons are like those in the dark ages. The sad thing is that the conditions are getting worse and not better. If you look at many of the prison movies you will think about how bad things were. Well my friends it is worse.
One guard said of the prison he was working at, “The only people that really belong here are the ones that go home at night.”
Capital Punishment:

Capital punishment is bad for many reasons. As far as I am concerned only God has the right to take a life. Even God lets things happen and when a person dies it is natural. God gave us souls and it is the murderer’s soul not God that makes the decision to take a life. In the case of illness or other natural causes it is not God who takes the life but it is the natural way of life. God gave us a free will so that we will not have to be bothered with by Him.
Capital punishment is more expensive than life in prison.
There are many innocent men and women on death row. Over 100 were released because of DNA testing. Think about those that they will not allow to have DNA testing, those where the DNA evidence is missing and those where DNA is not a factor.
Prisons and the death penalty are big business and the system from the arresting officer to the judges is full of corruption. A poor person does not have a chance because his lawyer will more than likely be inept, drunk or in cahoots with the prosecution.
A person will be on death row for 10 to 20 years. In that time people change. The person that is executed in most cases is not the same person who did the crime.
Warehousing of prisoners:
Prisoners are sent to prison and forgotten. Prisons are human warehouses. Most do not get the proper training and rehabilitation to return to society. Many come out worse than they were when they went in. Many learn not only from their mistakes but also the mistakes of others so that when they come out they are better criminals.
Most prisoners will eventually be released. It is the job of the system to rehabilitate the prisoners so they will not release a worse criminal into society. Maybe the prison system leaders should be made accountable for the actions of those released back into society. No it would not work. Can you imagine the warden being a convict too?
What can we do?
Fight with words. A sentence is worth a thousand pictures. Search the Internet for groups that fight the system and join ones that you are comfortable with.
What do we want?
We want to help fight crime by cutting it off before it becomes a crime. We want to help the addicts and alcoholics change and fight their addictions before they turn to crime or commit more crimes.
We want to help stop abuse that leads to crime.
We want to help ex cons start a new life and keep them from returning to their old lives of crime.
The core is that we want to help the lost souls find themselves and help them become contributing members of society.
We want to make this a better place to live.

Carmen's Story
Carmen is a very pretty lady. She is 40 but looks like she is 30 and sometimes she looks like a kid. She is petite. I can pick her up and kiss her with her feet off the ground. I can carry her around with not effort. She is very intelligent and she has a heart of gold. When you talk to her you instantly like her,
She worked as a bank teller and had a good future with the bank. She could be a branch manager now if it weren’t for one problem. Carmen is a crack addict.
A few years ago Carmen came to the building I live in. At the time it was a building full of addicts, dealers and hookers. When I moved in the management was cleaning it out. Some of the addicts are still here.
Carmen met a man who was a loan shark. She started using drugs when she was with him. They lived in the building. The police came one night and had a talk with him. They told him that he had to find a new profession or they were going to bust him.
Carmen moved out of his place and shares an apartment with a female friend. While she was visiting the guy they were watching a movie, US Marshals. US Marshals busted in. He was arrested for drugs and loan sharking. Since Carmen was in the room when he got busted she was evicted and banned from the building.
When I met her it was a date. She had dates to support her habit. (She was a hooker.) For me this was supposed to be a sexual experience only. Before long we fell in love. I had competition. The competition was crack and it still is.
I talked to the manager and he said Carmen could come into the building again. She was losing her place and I offered her a place to stay. No drugs in the apartment. No addicts in the apartment. After midnight if she left she could not come back in.
She tried to cut down. The first two nights were ok. The third night, she did not make it. She came in at about 11pm. She moved slowly and she talked slow and soft. She was constantly looking around and every noise was a mystery. Her eyes were wide. She looked like a child that had done something wrong.
She went into the bathroom and closed the door. She was in there along time. Finally I said I had to pee. She came out and I went in. I could smell the crack but I held my tongue. I went back to my desk and worked on the internet. She had her hand on the door and when I wasn't looking she started to open the door. I said; "If you go out that door do not come back." She left and I locked the door and went to sleep.
During the winter she was homeless. I told her when she needed a place to stay she could spend the night with me but she had to be clean (not high). Once she was in it was for the night. I was not going to get up in the middle of the night to letter her in.
I would talk to her about rehab. She had a son who used weed. I heard her talking to him and he was talking about smoking 5 or more blunts with weed a day. She could not say any thing. What she was doing was much worse. I told her about herself. She also has a little girl who was a crack baby. The baby has problems because of it. We talked a long time and she was saying she wanted to quit.
She would promise that she was going in the next day and get some crack for her last time. I told her as long as she did that she would not go in. She would not go in.
She promised many times and a couple times went in. She would go through the 5 day dry out treatment and not go back for the 30 day program.
I would tell her to come back after the 30 day program. She would knock on my door a few days later she would be clean and she would tell me she was staying clean.
As soon as I would take her back she would come in high again.
I haven't seen her in a week. She called the other day and said she would be in to see me in an hour and not show. Yesterday she called and said her food stamps were added to her card so she was going to get me some groceries. She would be here in a couple of hours. That was 10:30AM and I am still waiting at 5:30PM the next day.
Everyone that knows her want me to keep trying and they tell her that I am the only one she can depend on and she is close to losing me. I told her that as long as she was using crack I was going to see other women. I see three other women now and if Carmen gets rid of her habit they know that she is the only one I will be with. If she takes too long and one of the others straightens out their act I may end up with that one.
I love Carmen but I will not compete with crack. As long as a woman is abusing drugs and alcohol I will not commit to her. All of these women know about each other and 3 know each other. A friend of theirs just had her heart explode because of drugs. You would think that would be enough to get a person to quit.
As I have said many times she has to want to quit. As long as I am around she thinks she does not have to stop. The next time I see her I will tell her that I will not see her as long as she is on drugs. This time I will stick to it. It worked with Shirley. Maybe it will work with Carmen.
After three days of calls saying that she will be here in an hour Carmen showed up this morning.
She did not look high but she did look like she was mentally unbalanced. It was like she was going in and out of reality.
She was talking normally then she said, "I smell a dog; my nose is playing tricks on me. I see dog shit on the floor. My eyes are playing tricks on me."
Then she would be back to normal. She told me she was with some friends. She smelled a dog and asked her friends. One said yes and the other said no. The one that said yes was high and the one that said no was not. She decided she was smelling things. I don't think she realized that she went though that a few minutes ago with me.
She is also going through paranoia. The hall carpeting was removed and the floor is concrete. Foot steps in the hallway and the opening of the elevator doors echoes in the hallway and into my room. The stairway is next to my room so when someone uses the stairs it sounds like they are walking in my room.
This drives her crazy. She hears the noises and thinks someone is coming for her.
There were times when she would call me and tell me someone was in her room. Even at my place she would check the closet and bathroom thinking someone was in the room listening to us.
I told her that it was time for rehab. If she doesn’t do something now she may end up in as asylum or on the streets talking to herself. The drugs are messing with her brains. It may be too late. I hope not.
As she left she told me that she was going to rehab. She said she knows that if she doesn't go she is doomed. She has said it before.
Pray for her. She is a good woman with a bad habit. She needs help and she needs to let the real Carmen out.
Carmen quit doing drugs on her own. She went to detox for a week and has been clean for 4 months as of 10/31/02. She did go to drinking for a while but she did not over do it and has quit that to. She Has a job now.
