So here's my question.  If the courts leave decisions like civil rights and gay marriage 'up to the people', how will we ever progress if the majority are fearful of change?  Let's ask the people if African Americans should still have civil rights, let's ask some of the people if women should still have the right to vote.

the problem is that Americans define democracy as "majority rule." But that is not democracy. Democracy is everybody has a say, everyone has equal rights, everyone is involved, government is by consensus. Anglo-American "democracy" is proto-democracy. A half-step up from Napolean's "Liberal Empire" (you choose me and I make the rules), not much different, in fact, from the government of the Holy Roman Empire. The governments of continental Europe got it right, we need to catch up.
